Article 1: Purpose and general provisions

The present General Terms and Conditions of Sale determine the rights and obligations of the parties within the framework of the sale and use of the connected products for beekeeping marketed by Connected Beekeeping. The applicable terms and conditions are those in force on the date of payment (or of the first payment in case of multiple payments) of the order.

The products and services of Connected Beekeeping are exclusively intended for buyers with a SIRET. The SIRET used for the sale of honey can be used. The applicable regulation is that of the Commercial Code (art. L. 441-1 and following)

Article 2: Tariffs

The prices are indicated in Euros MwSt. excluding shipping costs. For purchasers outside France, products can be purchased tax-free by indicating their VAT number when ordering. Prices are updated annually.

The possession of a VAT number by the buyer is not mandatory.

Article 3: Conclusion of the online contract and payment

The customer completely executes the order on the website and gives his acceptance of the general conditions of sale. An email will be sent to confirm the order as well as the good execution of the corresponding payment. In case of subscription, billing calls will be automatically generated at each due date. The order is considered complete only if the payment is fully completed.

The customer can pay his order by one of the two following means of payment:
- bank transfer
- SEPA (GoCardLess solution:
In the case of bank transfers, the subscription fees must be paid in full at the time of purchase (Subscription "for life").

Article 4: Network coverage

As this is a connected product, it is imperative to check beforehand that the location where the equipment will be used is well covered by the network. Connected Beekeeping carries out coverage verification diagnostics on request from the customer. It is up to the customer to make a good state of the various places where he intends to use the material. Connected Beekeeping is not responsible for the network coverage and its consequences on the functioning of the device.

Article 5: Confidentiality of balance data

We guarantee the confidentiality of the data generated by the scales. The recorded weights and scale locations are only accessible to the scale owners. This data may be used for statistical purposes at the departmental level. Upon request we will remove your data from any statistical use.

If the customer wishes, Connected Beekeeping can transfer the real-time data to third parties designated by the customer.

Hive scales contain an "inaccurate" geolocation feature. This makes it possible to locate the scales in a given sector, but the point is never located on the exact location of the apiary.

Article 6: Delivery terms

The connected products are made to order. Deliveries are made within 1 to 3 months after the order. If the product is in stock, this is explicitly stated in the interface. In this case it can be delivered faster.

Article 7: Withdrawal period

The customer can return the ordered product within 2 months without any justification. The customer is responsible for the return shipping costs. In case of return, the product is refunded (except shipping costs) provided that it is in new condition (cleaned and no trace of damage).

Article 8: Intellectual property rights

The marks, names of domains, products, software, images, videos, texts or more generally any information object of intellectual property rights are and remain the exclusive property of Connected Beekeeping. No transfer of intellectual property rights is carried out through the present GTC. Any total or partial reproduction, modification or use of these goods for any reason whatsoever is strictly prohibited.

Article 9: Force majeure

The performance of Seller's obligations hereunder shall be suspended in the event of the occurrence of an act of God or force majeure that would prevent performance. The seller shall notify the customer of the occurrence of such an event as soon as possible.

Article 10: Nullity and modification of the contract

If any provision of this Agreement is invalidated, such invalidity shall not invalidate the remaining provisions which shall remain in full force and effect between the parties. Any contractual modification is only valid after a written and signed agreement of the parties.

Article 11: Protection of personal data

In accordance with the French Data Protection Act of January 6, 1978, you have the right to question, access, modify, oppose and rectify your personal data. By adhering to these general conditions of sale, you agree that we collect and use these data for the realization of the present contract.

Scale data is not personal data.

Article 12: Limitation of liability clause

Under no circumstances can the seller be held responsible for the use of the connected products.

Article 13: Applicable law

All the clauses contained in the present general conditions of sale, as well as all the purchase and sale operations referred to therein, shall be subject to French law.

Article 14: Warranty

All products are guaranteed for 1 year. This guarantee covers only the anomalies of functioning. During this phase the shipping costs of the parts are at the charge of Connected Beekeeping. The return shipping costs are at the charge of the buyer. The maintenance is carried out during the winter period only, that is to say from October 1 to March 31. 

Wearing parts (solar panel and batteries) as well as material damage caused by the customer (torn or broken connectors or antenna, damaged case, broken load cell, cut cable) are excluded from the warranty.

Beyond 1 year, Connected Beekeeping provides a workshop repair service at a very attractive rate.

Article 15: Availability of services

Connected Beekeeping has an obligation of means in terms of service accessibility and puts in place the necessary structures to make the data consultation site accessible 7 days a week and 24 hours a day. Nevertheless, Connected Beekeeping may suspend access without prior notice, in particular for maintenance and upgrades. Connected Beekeeping is in no way responsible for any damage that may result for the User or any third party. Connected Beekeeping may at any time remove all or part of its Services or modify their content, in particular for technical reasons, without prior notice. Connected Beekeeping reserves the right to refuse, unilaterally and without prior notice, to any User access to all or part of the Site. Such a decision could be taken in particular in the event of non-observance of the terms of this text by a User.

Article 16: Purchase of products by third parties other than the end user

The products Connected Beekeeping can be purchased by professional third parties to be resold or made available to end users. In this case, the third party buyer assures the totality of the relationship with the end user: both in the purchase phase and in the accompaniment to the installation but also in case of maintenance. Connected Beekeeping and the third party buyer agree before the contract on the actions to be taken so that the third party is autonomous in this mission. The third party buyer designates a unique interlocutor.

Particular case of the subscriptions:
In case of need of subscription for the exploitation of a material, the third purchaser transmits the complete co-ordinates of the final user (Name, Address, Email). Connected Beekeeping prepares the order in the name of the final user and ensures with him the payment of the order. In this precise case the end user does not need to have a SIRET. The conclusion of this subscription does not modify the responsibility of the third purchaser who remains the only and unique interlocutor of Connected Beekeeping for the totality of the phases of exploitation of the material (sale, installation, maintenance).

Article 17 : Processing time for communications

We provide unlimited support by email.
The communications by email are treated under 5 working days maximum. The requests for maintenance or analysis of anomaly are treated under 2 weeks wrought.
We are reachable by phone during the hours indicated on the front page of the website. These hours are variable according to the period of the year.
We are totally closed from July 1st to October 1st and do not ensure any activity during this period.

Article 18 : Cordiality

We commit ourselves to exchange with our customers in an honest and cordial way in all circumstances. By accepting the present conditions, the customer commits himself to do the same.
